Policy Implications

One of the objectives of the ICTSD DSU programme is to generate original research through Empirical studies showing policy implications. This entails analysing in a non-legalistic language the policy implications of a few landmark rulings from the last five years. The objective of these papers is to guide decision makers in capital as to the breadth and scope of policy that they can pursue under WTO agreements as interpreted and clarified by panels and Appellate Body.

With the proliferation of FTAs and RTAs, there is growing evidence of final decisions at the regional level being re-litigated at the WTO. This raises questions about the binding nature of law and jurisprudence at regional level of international law.
